The lawsuit, filed in the US District Court in White Plains, N.Y., alleges Pleasantville Police Officer Aaron Hess showed a reckless disregard for human life, most specifically the life of Danroy Henry Jr. The lawsuit alleges that Henry's civil rights were violated, and seeks unspecified compensatory and punitive damages.

We look forward to revealing essential evidence that will further support the true events from the tragic morning of October 17, 2010, the family said. These include 911 audiotapes, store surveillance video and the testimony and the police report filed by Aaron Hess who has yet to reconcile his actions that evening with contradictions between his statement, multiple eyewitnesses and the physical evidence from the scene.
